Acceptance:
All quotations
are subject to acceptance by RANCON Systems
at its head office in Markham, Ontario, Canada.
2•
Warranty:
Bridgeveyor products are guaranteed against
defects in workmanship and materials for a period
of one year from date of shipment or after 2,000
(TWO THOUSAND) hours of continual or intermittent
use, whichever comes first. This warranty applies
only to such equipment that has been properly
installed, used within the limitations set forth
in Bridgeveyor’s published literature
and bulletins, subject to proper, normal use,
properly lubricated and maintained, and remains
the property of the original purchaser. Bridgeveyor
/ Rancon shall not be held liable for any further
cost or expense, or indirect or consequential
damages. The one year warranty applies to all
equipment manufactured by Bridgeveyor Overhead
Systems. Guarantees on all other parts and components
will carry their respective manufacturer’s
warranty.
3•
Prices: Prices are F.O.B.
our factory, Markham, Ontario, Canada, and are
subject to adjustment due to increased cost
of material. In the event of general increases,
materials will be invoiced according to prices
prevailing at time of shipment.
4•
Terms:
1/3 deposit with purchase order, 1/3
on advice that goods are ready for shipment,
1/3 balance, net, 30 days.
5•
Cancellation: Orders placed
as a result of this proposal are not subject
to cancellation except by mutual consent, and
then only on terms that will indemnify Bridgeveyor
/ Rancon against loss.
6•
Shipping: If specific shipping
instructions are not shown on purchase orders,
routing will be at the discretion of our traffic
department. All reasonable care will be used
in shipping the equipment and Bridgeveyor /
Rancon will endeavor to make shipment within
the time estimated, but assumes no responsibility
for loss of, or damage to the equipment after
shipment from its plant, or for claims arising
from late delivery, or due to any circumstances
beyond its control.
7•
Delivery:
Delivery dates are based on normal expectancy
and are approximate. Also subject to fire, strikes,
accidents, procurement of materials and other
causes which are unavoidable or beyond our control
and any such contingency shall excuse any delay
in delivery or any failure to fill any order.
8•
Returns: Goods may be returned
for credit only if in good condition and after
prior written approval from our General Offices.
Non-standard items are not returnable. Returned
goods are subject to restocking charges.
9•
Claims: All claims for replacement
or shortages must be made in writing within
30 days from receipt of shipment. Bridgeveyor
/ Rancon shall then have the option of re-inspection
at the purchaser’s establishment before
allowing or rejecting the claim. Replacements
furnished on allowable claims are F.O.B. our
factory. Expenses incurred in connection with
claims for which Bridgeveyor / Rancon are not
liable will be charged to the purchaser. No
claims for correction will be allowed except
for work done with the written consent of Bridgeveyor
/ Rancon. Bridgeveyor / Rancon assumes no liability
for loss of time or other consequential damages
occasioned by failure of their equipment whatever
the cause.
10• Installation: Bridgeveyor
/ Rancon assumes no responsibility for improper
operation of equipment when considered by Bridgeveyor
/ Rancon to be a result of faulty installation
when equipment is installed by others. Any components
installed on a Bridgeveyor conveyor which are
not manufactured &/or supplied by Bridgeveyor,
will void any warranty on all equipment.
11•
Sales Terms and Conditions:
The aforestated terms and conditions are the
only ones accepted by Bridgeveyor / Rancon
unless agreed to otherwise in writing. Bridgeveyor
/ Rancon representatives are not authorized
to extend changes in terms or conditions,
or to vary specifications or prices.
• All
prices quoted do not include Goods and
Services Tax or Provincial Tax or any
other local taxes, licenses, building
permits, etc. which may be applicable
by law to this contract. These must be
paid by the purchaser of the said equipment.
• Purchaser
to ensure equipment will be provided with proper
and adequate lubrication to all chains and
components and to ensure that all gear units
are topped with oil and properly maintained
as such.
• We
will provide necessary safety devices only
as specified, any further safety devices including
basket guards, etc. as required by your laws,
will be the responsibility of the customer.
• In
all matters pertaining to this proposal the
laws of the Province of Ontario shall apply.
• Any
changes or additions to our equipment after
approval of documents or drawings will be considered
an amendment to our tender.
• Unless
otherwise specified in our tender all electrical,
pneumatic, hydraulic or other services or control
equipment which may be necessary for the functional
operation of our equipment will be supplied
by others.
• The
proposal herein contained is open for acceptance
by you within a period of 30 days from the
date that is submitted. |
